Action on DACA applications from December 7 in the US

In the latest developments in the US immigration scene, a new significant decision has been made regarding DACA in the US. On November 14, 2020, an eminent judge Nicholas Garauf is issued an opinion regarding the memorandum of July 28, 2020, signed by Chad. F. Wolf, the Acting Secretary.

On December 4, 2020, Judge Garauf is wanted the DHS to implement his opinions by taking certain actions. So, effective December 7, 2020, the USCIS is taking the following actions:

  • It’s accepting first-time requests to consider deferred action under DACA. These actions will be taken based on DACA policy terms in effect before September 5, 2017. They will also be as per the court’s order on December 4, 2020.
  • It’s accepting renewal requests for DACA based on DACA policy terms in effect before September 5, 2017. The acceptance will also be as per the court’s order on December 4, 2020.
  • It’s accepting applications for advance parole documents. This will be based on DACA policy terms in effect before September 5, 2017. The acceptance will also be as per the court’s order on December 4, 2020.
  • Under DACA, 1-year grants of deferred action will be extended to 2 years.
  • It’s extending authorization documents for 1-year employment under DACA for 2 years.

Although DHS will be seeking relief from Judge Garaufis’s order, it will comply with it as long as it remains in effect.
