Canada announces open work permit for PGWP holders

Highlights of PGWP open work permit for PGWP holders:

  • PGWP holders whose visa expires between September 20, 2021, to December 31, 2022, can extend their permit.
  • The permit can be extended for a maximum period of 18 months.
  • The holders of PGWP whose documents have expired or will expire by December 2022, can work in the interim period.

Abstract: Canada has announced a new open work permit or extension for PGWP holders.

International students in Canada with PGWP can extend their work permits or apply for a new work permit. The changes in the PGWP policies were finalized last week.

The changes will be applicable to the PGWP holders whose permit expires between September 20, 2021, and December 31, 2022. International students who have graduated from full-time programs can be issued an open work permit valid for a maximum of three years.

The new policy will facilitate eligible PGWP holders to apply for an extension of their work permit or apply for an open work permit valid for 18 months.

One can apply for an extension or new permit online after they have entered the country.

PGWP Holders can Work during the Interim Period

Those who are in Canada can work in the interim duration when their application for an extension or a new work permit is being issued.

IRCC or Immigration, Refugees, and Citizenship Canada will send notices via email to PGWP holders whose documents have or will expire by December 31, 2022. The email will inform them that they have permission to work in Canada in the interim period while their application is being processed.

IRCC has clarified that the notification will not restore the legal status as a temporary resident if the status has expired. It is intended to facilitate PGWP holders to work since their permit has expired.

What to do if the Status has Expired?

If one is out of status, they can apply for the restoration of the status simultaneously.  If one is eligible, one can apply to restore even if it has been more than 90 days since the date of expiration.

If one is not in Canada and has a valid temporary resident visa, they can come back to Canada and are authorized to work. The interim work authorization email notice is not valid to return to Canada.

The recent changes in the policy can help international graduates to apply for Canada PR or permanent residency. The changes in work permits will help the international graduates gain valuable work experience and make them eligible for CEC or Canadian Experience Class pool. They can consequently apply in the Express Entry pool for Canada PR.

 What is DAMA?

A Designated Area Migration Agreement (DAMA) is a unique arrangement allowing businesses in designated regions that access more flexible skilled visa pathways. Here are the benefits of DAMA:

  • Expanded occupation list beyond standard skilled visa category
  • Concession on skills, experience, and English Language requirements to attract more workers
  • Support for employers struggling to find local talents
     

Individual DAMA Labor Agreements are formal arrangements made between the Australian government, approved employers, and businesses operating in a designated region.
 

Agreements are typically:

  • Valid for five years
  • Operate through following :
  • Subclass 482 – Skills in Demand (SID)
  • Subclass 494 – Skilled Employer Sponsored Regional (Provisional)
  • Subclass 186 – Employer Nominated Scheme (ENS)

Eligibility Requirement to apply for DAMA

To apply for the Northern Territory Designated Area Migration Agreement (DAMA), an applicant must:

  • Applicant must be sponsored by an approved employer based on the designated area
  • Must demonstrate they have made a genuine attempt to hire local Australian worker
  • Only occupations included in DAMA are eligible
  • Employers must provide a genuine job offer to overseas workers
  • Apply through the NT DAMA portal along with the necessary documentation.
