Details about the new rules

The new rule for foreigners became effective on November 18th, 2023. A foreigner can temporarily work and reside in Denmark without a residency and work permit. However, a necessary condition is that a foreign employee must be employed in a company located in Denmark and have at least 50 employees.

The new rule also makes it possible to work in the company in Denmark for two separate working periods within 180 days: 

  • Each working period can consist of a minimum of 15 working days. 
  • The employee must stay outside Denmark for at least 14 days between each working day. 

Moreover, the individual must be allowed to enter and stay in Denmark either as a citizen of a visa-free country or as an individual who has been issued a visa to use the new rule.

In a specific industry, the rule only applies if the company is of management work or requires high and intermediate-level knowledge. The specific industries are:

  • construction
  • agriculture
  • forestry and horticulture
  • cleaning (including window cleaning)
  • hotel and catering
  • carriage of goods by road.

Rules are exempt for the following:

  • Exempt for general
  • Exempt for a maximum of 40 days per year if you are a board member.
  • Exempt for a maximum of 90 days for a particular work assignment
  • As a guest teacher, they can exempt up to five days.  

Artists, musicians, performers, and associated staff can be exempt from work permit requirements if they are essential to a significant artistic event.

The guest teacher also doesn’t need a work permit if they attend the lecture within 180 days at an educational institution under the Ministry of Higher Education and Science or the Ministry of Culture.
