Among the US immigration policies adopted by the erstwhile Trump administration, the plan to cancel the right to work of workers who are spouses of H-1B visa holders has been a major one for the Biden administration to abolish. And the Biden administration seems to be determined to do it.
Donald Trump had intended to take away the right to work in USA from spouses of H-1B visa holders who held H-4 visas. The H-4 visa gave them the right to work if their spouses held an H-1B visa and they are on the path to obtaining the Green Card. Since 2017, the Trump administration has been keeping the proposal alive though it wasn’t finalized. The uncertainty that followed has given rise to unrest and litigations.
However, the right to work for H-4 holders was widely supported by the US industry. Major companies of the information technology industry in the US joined the National Association of Manufacturers, the US Chamber of Commerce, and outsourcers in supporting the right of H-4 holders to continued employment.
The H-4 holders will now welcome the scrapping of the proposed work-ban on them that could take away their right to work in USA. This will be a significant policy step for the Biden administration in the scope of USA immigration.
