H-1B visa procedure in the USA;new system proposed

There are 2 H-1B visa selection procedures that are competing for renewed acceptance in the USA. One is the current system of a random selection of petitions for H-1B wherein petitions are accepted in random totaling to a number that falls under the cap-subject petitions limit. The other is a proposed system wherein petitions will be chosen for acceptance based on the wage levels with the highest wage categories accepted first.

As the number of H-1B applications/petitions consistently exceeded through the years, the system of a random selection of applications/petitions was implemented. But as the system didn’t look like an optimal solution, it was proposed to be replaced by another system by the Trump administration. In this one, petitions were selected by prioritizing them based on the level of wages paid to the applicants.

The goal of the new proposal is to incentivize the US companies to pay beneficiaries wages that are higher which equals or exceeds higher prevailing wages.

But the shortfall of the new proposed plan will be in that it could fail to employ foreign candidates who have just completed Masters or Doctoral degrees at US universities and colleges,willing to work in USA in specialized sectors. Also, very few to none of those paid Level 1 or Level 2 wages will be selected to go ahead with an H-1B petition.
