USCIS Accepting Petitions for:

The petition that USCIS would accept needs to fall under the category of:

 

  • Only if the current H-2B worker in the United States wishes to extend their stay and, if applicable, can change the term of their employment or their employers.
  • Employers from the fish roe department such as:Fish roe processors, fish roe technicians and/or supervisors of fish roe are eligible.
  • Till 31st December 2029, workers doing labour or services in the Commonwealth of the Northern Mariana Islands and Guam can file a petition.

Filing dates for supplementary visas:

The Department of Homeland Security (DHS) and the Department of Labor (DOL) published the initial final rule on November 17, 2023, that increased the number of non-immigrant visas to 64,716 additional visas for F.Y. 2024.

 

The supplementary visas are for U.S. businesses going through some financial harm without the ability to employ all the H-2B workers. These supplementary H-2B visas are for U.S. employers issuing petitions for additional workers for in that specific fiscal year.

 

Here are the dates of filing the supplementary visas that are categories under temporary final rule:

 

  • USCIS will start accepting petitions from March 22, 2024, for employers who are looking for workers from El Salvador, Guatemala, Honduras, Haiti, Colombia, Ecuador, and Costa Rica, regardless of whether such nationals are returning workers with a starting date of April 1, 2024, to September 30, 2024.
  • USCIS will begin accepting petitions from March 22, 2024, for an additional 19,000 visas for employers looking for returning workers for the early second half of F.Y. 2024 (April 1 to May 14), regardless of country of nationality.
  • USCIS will begin accepting petitions from April 22, 2024, for an additional 5,000 visas for employers looking for returning workers for the late second half of F.Y. 2024 (May 15 to September 30).

Required Fee and Form Editions for H-2B Petitions:

USCIS announced a final rule published in the Federal Register on January 30, 2024, adjusting the fees required for most immigration petitions and applications. The new fees will come into effect from April 01, 2024.

Employers must include the new fees while filing H2B petitions after April 01, 2024. The grace period will be eliminated for those filing the new version of Form I-129, as it will include the new fee calculation.
