How to calculate time spent in Canada for Canadian citizenship application?

Candidates must reside in Canada for 1095 days for three years in the course of the five-year immediate date signed for Citizenship to qualify for Canada PR.

 

For Canadian Citizenship, IRCC prefers the candidate to be present.

 

However, citizens can check their Canadian citizenship application from the citizenship calculator. Citizen applications help calculate your time in Canada and your eligibility to be a citizen of Canada.

Types of Canadian Resident:

As defined by IRCC, there are two types of residency:

 

  • Temporary Resident
  • Protected Person
  • Temporary Resident: Foreign nationals who can reside in Canada as visitors, student workers, or TR permit holders are known as Temporary resident 
  • Protected Person: A protected person was either found to be covered or a refugee by the IRCC or obtained a favorable judgment on a Pre-Removal Assessment" from the IRCC. For example, refugee claimants are protected persons that include their family members, as refugees claim.

Evaluate the individual stayed in Canada:

The IRCC explains that for both types of Canadian residents in Canada, one day spent in Canada in five years is considered half a day of being physically present.

That means they can only have 365 days in Canada after becoming a Permanent resident.

 

For example:

Temporary Resident:

Romit will opt for his citizenship application in March 2024. After attending Canada as a student in September 2019, Romit became a resident in 2022. 

He stayed in Canada from that time and never left Canada.

 

Romit registered for Citizenship in Canada on March 24, 2024. So eventually,

  • The five years used to tally Romit's physical presence in Canada were from March 24, 2019, to March 23, 2024.
  • The time before that date, March 24, 2019, will not be considered.
  • Romit has remained in the country since arriving in Canada, but the IRCC states that any day an applicant is not physically present in Canada will not be considered.

As each day is counted as 0.5 days in Canada, Romit can utilize 365 days out of 855 days.

So, to further calculate:

  • Time consumed as a PR: January 6, 2022 to March 23, 2024 (808 days)
  • Eight hundred-eight days can be measured towards his physical presence requirement.

365 days (TR) + 808 days (PR) = 1,173 days

 

Protected Person:

Suresh arrived in the country as a protected person in 2021 and will sign the application for Citizenship on July 16, 2024. Suresh became PR in 2023. Since then, Suresh has stayed protected till now.

 

Suresh applied for the Citizenship on July 16, 2024. So eventually,

  • The five years used to tally Suresh's physical presence in Canada from July 16, 2019, to July 15, 2024.
  • The day before his arrival date, July 16, 2019, will not be counted.
  • Suresh has remained in the country since arriving in Canada.

Since the day he arrived as a protected person, from then onwards, every day is counted as 0.5 days towards this total (max 365 days). Suresh can utilize 320 days as a Temporary resident for the physical presence requirements.

 

So the calculation will be:

  • Time consumed as a Permanent resident: February 19, 2023, to July 15, 2024 (513 days)
  • All 513 days can be calculated for his physical presence requirement.

320 days (TR) + 513 days (PR) = 833 days

 

Permanent Resident:

Since 2017, Riya has been a permanent resident and will sign her application for Citizenship on June 6, 2024. Riya returned home to attend to her matters Between January 18 and August 18. 

 

Riya signed their Canadian Citizenship on June 6, 2024.

  • The five-year period used to calculate Riya's physical presence in Canada is June 6, 2019, to June 5, 2024.
  • From June 6, 2019, the time will be considered.
  • Riya spent 277 days away from Canada, implying that the 277 days will not be considered.

 

Time consumed as a Permanent Resident in the country between eligible dates: June 6, 2019, to June 5, 2024.

So, to calculate:

  • However, all 1,827 days will not be calculated towards her physical presence requirement as the time spent away from Canada (227 days) must be deducted from that totality.

 

1,827 days (PR) - 227 days (Away from Canada) = 1600 days

 

IRCC additional requirements to be a citizen of Canada 

  • All applicants must be physically present to be permitted for Citizenship.
  • IRCC indicates minors without Canadian parents or parents need to complete the same criteria as the child.
