Benefits of NIW application:

  • You don't need a job offer in the US.
  • You don't need an employer.
  • NIW only focuses on qualifications beyond a threshold. Instead, it focuses on how it will help the USA.
  • As an employer is not required, you can move between jobs freely as long as you would before or after receiving a green card focusing on the intended project or effort.
  • A priority date is established, and you can be moved to a faster category of green cards any time you qualify (Employment-Based Category-1, EB-1).
  • The qualifying petition Form I-140 is under Premium Processing by paying extra fees to USCIS, reducing the cycle by a few weeks.
  • The approved NIW stays valid forever.
  • It doesn't matter how often an individual files a NIW petition under another category of green card.

 

Pros for candidates who are present or already working in the US:

  • You can establish a priority date that can be moved to any case with any employer in any employment category. The priority date can be pushed to the EB-1 category.
  • The H1B extensions can go beyond six years with any employer.
  • If an individual has an H1B visa, your spouse can receive employment H-4 EAD and continue its extension.  

 

Cons of NIW application:

  • The NIW petition is based on USCIS approval; hence, it cannot be guaranteed.
  • It might be difficult for an individual to obtain a specific short-term visa or non-immigrant visa, such as a visitor visa if their file fails, as they would have to show the intention to move to the US permanently rather than a temporary visa. Visas like H-1 and L-1 are prone to this problem.
  • An NIW falls under the category of EB-2, for which the application of NIW can take a lot of time. However, if you or your spouse were born in a country that agrees with the US, the completion period could be closer to a year. The government of birth will be considered.
  • In the end, the Nation Interest was an excellent option for individuals who have advanced degrees or exceptional abilities and are ready to contribute to the national interest of the United States. Though there are cons, the Pros NIW can be considered an attractive choice for those looking for a Green Card.
