Important things to know about the Partner Visa of Australia

The Partner Visa of Australia allows the spouse/partner of an Australian PR or citizen to live in Australia. Partner Visa applicants must be married to or in a common-law relationship with an Australian PR or citizen. Same-sex partners are also eligible to file for a Partner Visa. Many couples file for the Partner Visa in an eagerness to live together instead of in a long-distance relationship. 

Applying for a Partner Visa is complex and time-consuming. Under the Partner Visa, the applicant must be sponsored for 2 years by the Australian partner. In the case, your relationship is genuine and continuing, you may then apply for a Permanent Partner Visa. 

Here are all the things that you should know about the Partner Visa of Australia: 

  • The commitment and the duration of your relationship is important 

While applying for a Partner Visa, you would need to prove evidence that you are in a long-term, committed relationship with your partner. 

  • De-facto relationships must be genuine and at least a year-long 

In case you are in a de-facto relationship, you would need to prove that your relationship is genuine and subsisting. You should have lived together for at least a year and also provide evidence of your relationship. The evidence could be: 

Photos of both of you together  

Joint finances 

Chat and text messages 

Documents of any holidays that you have taken together etc. 

  • Irrespective of your marital status, you may register a de-facto relationship and lodge a Partner Visa  

Under Australian laws, you cannot marry your partner until they are legally married to another person. However, you may register a de-facto relationship as long as one of the partners is legally separated from their previous partner. 

A Partner Visa is submitted when you can prove that your previous marriages have ended, as per SBS News. You will need to provide evidence that you are living separately and there is no characteristic of a marriage. 

  • Partner Visa processing time 

The Partner Visa of Australia is time-consuming and different applications could have different processing times. However, the general processing time is as below: 

75% of the Subclass 309 (Temporary Partner Visa) applications are processed within 13 months 

90% of the Subclass 309 (Temporary Partner Visa) applications are processed within 17 months 

75% of the Subclass 100 (Permanent Partner Visa) applications are processed within 17 months 

90% of the Subclass 100 (Permanent Partner Visa) applications are processed within 25 months
