Abstract: Germany announced the Right of Residence aimed at settlement of immigrants.

The Right to Residence has made Germany more attractive for foreign nationals who were planning to migrate overseas.

The newly introduced program and other laws of Germany facilitate foreign nationals in the country to legally reside, migrate to the country, and gain Germany PR. It was brought into effect on January 1, 2023.

The recently introduced law was published on December 30, 2022, in the Federal Law Gazette. It will offer approximately 140,000 international individuals who have been living in Germany under tolerates status the opportunity to stay in Germany with a residence permit valid for 18 months.

These are the requirements to avail of the Right to Residence:

  • Employment in Germany
  • Staying in Germany for the past five years
  • No criminal offense
  • Individuals who believe in free democratic basic order

As of October 31, 2022, more than 248,182 foreign nationals were residing in Germany, and 137,373 have been staying for over five years.

Other policies introduced in Germany

The other policies on residence were implemented recently, which offers young people aged 27 or less the opportunity to stay in Germany within 3 years instead of 4 years.

The short-term requirements for the Skilled Immigration Act will be made permanent and eventually permanently applicable. It would help candidates in Germany become more attractive to skilled professionals from other countries.

Skilled professionals can bring their family members to Germany without a certificate for German language proficiency.

Asylum seekers can also avail of integration courses and language courses, irrespective of their country of origin or arrival date.
