Overview:

Ontario Immigrant Nominee Program (OINP) is set to implement Canada’s latest National Occupational Classification (NOC) system of 2021.

The government of Canada is inclined towards utilizing the new system in the province of Ontario from November 16, 2022. This is said to organize the occupations that are based upon Training, Education, Experience, and Responsibilities (TEER), instead of skill levels.

New NOC system to implement from November 16, 2022

A few changes were applied to the eligibility criteria of the Ontario Immigration Act, by the Ministry Of Labour, Immigration, Training, And Skills Development of Ontario on September 6, 2022.

Statistics Canada and Employment and Social Development Canada have already started using the new NOC system of 2021, as their authorized classification system. The OINP would be aligning with this these renewed changes effectively, from November 16, 2022.

This new system is said to organize occupations that are based on Training, Education, Experience, and Responsibilities (TEER), instead of skill levels.

Even though the new system of the NOC is said to be introduced by the IRCC, the federal government has been assisting individuals from foreign countries, willing to migrate to Canada under the Express Entry programs.

In the view of renewed NOC system affecting the jobs under each of the OINP streams, Ontario is taking the opinion of individuals until September 30, 2022.

The applicants under the OINP system are provided the access to review all the details of the NOC 2021 system on the website of Statistics Canada and IRCC. These individuals will also be provided with all the necessary updates from the websites.

The NOC changes will be applied to the following criteria under different streams, They are;

  • Education criteria of the Employer Job Offer International Student stream
  • Language criteria of the Employer Job Offer Foreign Worker stream
  • The administrative penalties of Ontario’s Immigration Nominee Program

In August 2022, the Immigration, Refugees, Citizenship Canada (IRCC) suggested all foreign nationals arriving under the program of Express Entry, be well aware of the new NOC, since it may impact their applications.

In case any candidate will be submitting their Express Entry profile on or after November 16, 2022, will have to search for their profession under the list of NOC 2021, on the Employment and Social Development Canada (ESDC) website. They are also required to submit their occupation code of five digits, under the category of Training, Education, Experience, and Responsibilities (TEER).

Express Entry applicants to update their NOC Codes

The immigration candidates who have submitted their Express Entry profile, and haven’t received an Invitation to Apply (ITAs) yet, need to

  • Update or replace the profile with TEER category and occupational code that contains five digits
  • Look for their profession on the ESDC website, under the NOC 2021 list

For the applicants to still have the eligibility, they must update their profiles on or after November 16, 2022 under programs like;

  • Express Entry program
  • Canadian Experience Class (CEC) program
  • Federal Skilled Trades (FST) program
  • Federal Skilled Worker (FSW) program

To submit the applications for permanent residence, the foreign nationals must make use of NOC 2016, which will be made available only until November 16, 2022.

The NOC will be changing the five-digit code to four digits in order to categorize all the occupations, under the rest of the changes that are expected to be implemented from November 16, 2022.

Until mid-November, the government of Canada is inclined towards utilizing the new system in the province of Ontario by organizing the level of skill under each occupation.

This is further divided into six categories four, based upon Training, Education, Experience, and Responsibilities (TEER), replacing the present skill levels.

The new system of the NOC will be ranking the occupational groups depending on its five levels which have;

  • Major groups
  • Broad occupation category
  • Minor groups
  • Sub-major groups
  • Unit groups

The implementation of the new NOC system is said to provide the programs and organizations, sufficient time to make the NOC 2016 to NOC 2021 changes correctly.
