Details of what are the new policies:  

To streamline regulations and enhance transparency, the US Citizen and Immigration Services (USCIS) has updated its F and M student visa policy. To get a US Green Card, students need to maintain these policies that are:  

 

Maintaining Foreign Residence: Students on F and M visas must keep foreign residence without permanently abandoning their old home. Despite this, international students can now apply for permanent residency through green cards in the US, provided they have to prove their intention to return to their home country after their temporary stay.

 

As the guidelines suggest, F and M students must have a foreign residence that they don’t intend to abandon, and they will benefit from a permanent labor certificate application or immigrant visa petition. They may still be able to demonstrate their intention to depart after a temporary period of stay.

 

STEM OPT and Start-ups: The policy extends Optical Practical training for F1 students seeking employment opportunities with start-up companies in the stem field. The start-up company must provide some required documents, such as:

 

  • Adherence to outlined training plans
  • Good standing with E-Verify
  • Providing compensation comparable to US workers.

Rules that will not change through this policy:

The fundamental requirements for F and M visas will remain the same. The visa procedure of:

 

  • school transfer procedures
  • and general employment rules

 

It will remain unchanged. The non-immigrant academic student (F-1) allows a non-citizen to enter the United States full-time at a college, university, seminary, conservatory, academic high school, elementary school, or other academic institution, or in a language training program.

 

The non-immigrant vocational student (M-1) classification allows students in established vocational or other recognized non-academic programs, other than language training programs, to reside in the US freely as it was before.
